  • have a husband or partner who is supporting and well aware of the situation
  • have a good heterosexual relationship

Important note:

The Assisted reproductive Technologies (Regulation) Bill of Government of India, 2010 states that:

"To avoid legal complications in cases involving foreigners, it is mandatory for them to submit certificates on their country’s policy on surrogacy. Foreigners also need to submit a certificate that the child born to an Indian surrogate mother will be allowed entry in the commissioning parent/’s country. The commissioning couples are also required appoint a local guardian to take care of the surrogate."
